Terms of Service

These terms govern your use of Argus, operated by Argus Intelligence Inc. ("we", "us"). By creating an account or using the Service you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind it.
The Service
Argus connects to your email, calendar, and phone number and uses artificial intelligence to read incoming customer enquiries, draft and send replies, book estimates, assemble quotes, and track enquiries as leads. Features vary by plan and change over time.
Your account
- You must provide accurate information and keep your login secure.
- You are responsible for everything that happens under your account.
- You must be at least 18 and using the Service for business purposes.
- Tell us promptly if you believe your account has been compromised.
What you are responsible for
This is the part that matters most, because the Service communicates with your customers in your name.
- You own the output. Messages the assistant sends go out from your email address or your phone number and are your communications with your customers. You are responsible for them.
- Review what matters. AI-generated text can be wrong, incomplete, or inappropriate to the situation. Automatic sending is optional and off by default for new accounts; if you enable it, you accept that messages go out without your prior review. We strongly recommend keeping quotes, pricing commitments, and anything contractual under human approval.
- Quotes and prices are yours. Any estimate, price, or availability the assistant communicates is an offer made by your business, not by us.
- You have the right to connect the mailbox. You confirm you are authorised to grant access to the mailbox, calendar, and phone number you connect, and to have us process the messages in them.
- Follow the law where you operate. This includes rules on marketing calls and texts, call recording and consent, and privacy. Where a law requires you to disclose that a caller is speaking with an automated system, or to obtain consent before recording, meeting that requirement is your responsibility.
- Texting rules. If you use the Service to text customers, you must only message people who have a genuine relationship with your business or have asked to hear from you, and you must honour opt-out requests.
Acceptable use
You may not use the Service to:
- send spam, bulk unsolicited marketing, or anything deceptive;
- impersonate another person or business;
- break the law, infringe intellectual property, or violate someone's privacy;
- attempt to breach, overload, reverse-engineer, or circumvent limits on the Service; or
- resell or white-label the Service without our written agreement.
Third-party services
The Service depends on Google, Microsoft, Twilio, Stripe, and our AI providers. Your use of those services through Argus is also subject to their terms, and we are not responsible for outages, changes, or decisions they make — including a provider suspending access to your account or changing what their APIs permit.
Fees and billing
- Subscriptions are billed in advance on a recurring basis through Stripe.
- Usage-based add-ons, such as the AI voice agent, are billed in arrears for what you used.
- Fees are non-refundable except where the law requires otherwise.
- You can cancel at any time; cancellation takes effect at the end of the current billing period and the Service continues until then.
- We may change pricing on at least 30 days' notice before it applies to your next renewal.
- If a payment fails and is not resolved, we may suspend the Service.
Your data
You keep all rights to your data and your customers' data. You grant us only the licence needed to operate the Service for you — to process, store, and transmit that data to provide the features you have enabled. Our handling of it is described in the Privacy Policy, which forms part of these terms. We do not use your data to train AI models.
Availability
We work to keep the Service running but do not guarantee uninterrupted availability. We may perform maintenance, and we may modify or discontinue features. If we discontinue the Service entirely we will give reasonable notice and a way to export your data.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the assistant's output will be accurate, complete, or suitable for any given situation, or that the Service will identify every enquiry or respond to every message.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business, or lost data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Indemnity
You agree to indemnify us against claims arising from your use of the Service, your communications with your customers, or your breach of these terms or of applicable law.
Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate an account that breaches these terms, creates risk or legal exposure, or is not paid for. We will give notice where it is reasonable to do so.
Changes to these terms
We may update these terms. We will post the new version here and update the date. Material changes take effect no sooner than 30 days after we notify you; continuing to use the Service after that means you accept them.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. The state and federal courts located in the State of Delaware have exclusive jurisdiction over any dispute arising out of or relating to them.
